8. Acceptable Use Guided by Grace is intended to provide a safe, encouraging, and Christ-centred environment where girls can grow in their faith, reflect on devotional content, and encourage one another through Grace Circle. By using the App, you agree to use it responsibly, respectfully, and in accordance with these Terms, our Community Guidelines, and applicable laws. You must not: * use the App for any unlawful or unauthorised purpose; * harass, bully, threaten, intimidate, or abuse another user; * post content that is offensive, hateful, sexually explicit, violent, defamatory, or otherwise inappropriate; * share personal information about yourself or another person, including home addresses, schools, phone numbers, email addresses, passwords, or other sensitive information in publicly visible areas of the App; * impersonate another person or falsely represent your identity or affiliation; * interfere with the security or operation of the App; * attempt to gain unauthorised access to the App or another user's account; * upload malicious software or use automated tools to access the App without our permission; or * encourage another person to breach these Terms or our Community Guidelines. If you breach these Terms or our Community Guidelines, we may review the matter and take appropriate action. Depending on the circumstances, this may include: * removing content; * restricting access to certain features; * issuing a warning; * temporarily suspending your account; * permanently closing your ac * count; or * reporting unlawful activity to the appropriate authorities where required or permitted by law. We will take action that we reasonably believe is appropriate in the circumstances. 9. The Grace Circle Community Grace Circle is a moderated community within Guided by Grace where users can encourage one another by sharing positive experiences, faith-based reflections, prayer requests, and uplifting messages. By participating in Grace Circle, you agree to comply with these Terms and our Community Guidelines. Reporting Content If you believe that content or behaviour breaches these Terms or our Community Guidelines, you may report it using the reporting feature available within the App. Reported content may be reviewed by our moderation team. Moderation To help maintain a safe and encouraging community, we may review reported content and take appropriate action where we reasonably believe these Terms or our Community Guidelines have been breached. Depending on the circumstances, this may include: * removing content; * restricting access to community features; * issuing a warning; * temporarily suspending an account; or * permanently closing an account. We make moderation decisions in good faith to help protect the safety, wellbeing, and positive experience of our community. No Expectation of Continuous Monitoring While we review reported content and moderate Grace Circle, we do not guarantee that all user-generated content will be reviewed before it becomes visible or that inappropriate content will never appear. If you encounter content that concerns you, please report it using the reporting feature available within the App. 10. User-Generated Content Certain features of Guided by Grace, including Grace Circle, allow users to create, post, and share content ("User-Generated Content"), such as posts, comments, prayer requests, journal prompts, and other contributions. Your Responsibility You are solely responsible for the User-Generated Content you submit through the App. By posting User-Generated Content, you confirm that: * you own the content or have permission to share it; * your content complies with these Terms, our Community Guidelines, and applicable laws; and * your content does not infringe the intellectual property, privacy, publicity, or other legal rights of any person or organisation. Ownership of Your Content You retain ownership of the User-Generated Content you submit. Nothing in these Terms transfers ownership of your content to Guided by Grace. Licence to Use Your Content By posting User-Generated Content, you grant Guided by Grace a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, transmit, and otherwise use your content solely for the purpose of: * operating and maintaining the App; * providing Grace Circle and other community features; * displaying your content to other users as intended within the App; * moderating and reviewing reported content; * maintaining, securing, and improving the App; and * complying with applicable law or enforcing these Terms. This licence ends when your content is deleted from the App, except where we are required to retain it to comply with applicable law or to establish, exercise, or defend legal claims. Removal of Content Where reasonably practicable, you may delete content that you have posted through the App. We may also remove or restrict access to User-Generated Content where reasonably necessary to: * enforce these Terms or our Community Guidelines; * comply with applicable law or legal obligations; or * protect the safety, rights, or legitimate interests of our users or Guided by Grace. No Endorsement User-Generated Content reflects the views of the individual user who submitted it and does not necessarily reflect the views of Guided by Grace. We do not endorse or guarantee the accuracy, completeness, or reliability of User-Generated Content submitted by users. 11. Reporting Content If you believe that content or behaviour breaches these Terms or our Community Guidelines, you may report it using the reporting feature available within the App. Reports are reviewed by our moderation team in good faith and within a reasonable period. Please use the reporting feature responsibly. Repeated false or malicious reports may result in action being taken against your account. The reporting feature is not intended for emergencies. If someone is in immediate danger, contact your local emergency services. Moderation To help keep Grace Circle safe, we may review reported content and take appropriate action where we reasonably believe these Terms or our Community Guidelines have been breached. Depending on the circumstances, we may: * remove content; * issue a warning; * restrict access to community features; * temporarily suspend an account; or * permanently close an account. We make moderation decisions in good faith based on the information reasonably available to us. While we moderate Grace Circle, we do not guarantee that all User-Generated Content will be reviewed before it becomes visible or that inappropriate content will never appear. Nothing in these Terms requires us to monitor all activity within the App. 12. Intellectual Property and Licence Ownership All intellectual property rights in Guided by Grace, including the App, devotional content, graphics, artwork, logos, software, databases, trademarks, and other materials made available through the App ("Content"), are owned by or licensed to Guided by Grace and are protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of the App or its Content to you. Licence Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download, access, and use the App on devices you own or control solely for your personal, non-commercial use. The App is licensed, not sold. Restrictions Except where permitted by law, you must not: * copy, reproduce, distribute, or commercially exploit the App or its Content; * modify or create derivative works from the App; * reverse engineer or attempt to access the App's source code; * remove copyright or trademark notices; * interfere with the security or operation of the App; or * use the App for any unlawful or unauthorised purpose. Third-Party Services The App uses certain third-party services, including Firebase, to provide functionality. Your use of those services may also be subject to the terms and policies of those providers. Updates We may release updates, bug fixes, security patches, or new features from time to time. Unless otherwise stated, these updates form part of the App and are governed by these Terms. Suspension of Licence This licence remains in effect until it is terminated by you or by us. We may suspend or terminate your licence if you materially breach these Terms or where reasonably necessary to protect the security or operation of the App or comply with applicable law. Upon termination, you must stop using the App and, where applicable, remove it from your devices. Reservation of Rights All rights not expressly granted under these Terms are reserved by Guided by Grace and its licensors. 13. Apple App Store Additional Terms If you download or use Guided by Grace through the Apple App Store, the following additional terms apply: * These Terms are entered into between you and Guided by Grace only, and not with Apple Inc. Apple is not responsible for the App or its content. * Your licence to use the App is limited to a non-transferable licence to use the App on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions. * Apple has no obligation to provide maintenance or support services for the App. * To the extent permitted by law, Apple has no warranty obligations in relation to the App. Where any warranty cannot lawfully be excluded, Apple may refund the purchase price (if any) paid for the App, but will have no other warranty obligations. * Guided by Grace, and not Apple, is responsible for addressing any claims relating to the App, including claims concerning product liability, legal or regulatory compliance, consumer protection, privacy, or intellectual property infringement, to the extent required by applicable law. * You represent and warrant that: * you are not located in a country subject to a United States Government embargo or designated as supporting terrorism; and * you are not listed on any United States Government list of prohibited or restricted parties. * Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. * Nothing in this section limits any rights or remedies that cannot lawfully be excluded or restricted under applicable law. 14. Devotional Content Disclaimer Guided by Grace is intended to encourage users in their Christian faith through Scripture, devotional content, prayer, journaling, and personal reflection. The devotional content reflects the personal beliefs and experiences of the author and is provided for inspirational and educational purposes only. While we seek to ensure that our content is thoughtfully prepared and biblically grounded, individual users may hold different beliefs, traditions, or interpretations. We encourage users to read the Bible for themselves and, where appropriate, discuss questions of faith with their parents, guardians, church leaders, or other trusted Christian mentors. Guided by Grace is not intended to replace personal Bible study, parental guidance, pastoral care, or professional medical, psychological, legal, financial, or other professional advice. Your use of the devotional content is voluntary, and we do not guarantee any particular spiritual or personal outcome from using the App. Nothing in this section limits any rights that cannot lawfully be excluded under applicable law. 15. Journal Privacy The Journal feature provides a private space for users to record personal reflections, prayers, devotional responses, and notes. Journal entries are private and are not shared with other users through Grace Circle. You are responsible for the information you choose to record. We recommend that you do not include highly sensitive personal information in your journal. We use reasonable technical and organisational measures to help protect journal data. However, no electronic storage or transmission method is completely secure. You may edit or delete your journal entries at any time using the features provided within the App. If you delete your account, your journal entries will also be deleted or anonymised within a reasonable period, except where retention is required by law. Journal entries are handled in accordance with our Privacy Policy. 16. Push Notifications If you choose to enable push notifications, Guided by Grace may send reminders and service-related notifications, including: * daily devotional reminders; * morning and evening encouragement; * important account or security notifications; and * service announcements relating to the operation of the App. Push notifications are optional and can be turned off at any time through your device settings. We use third-party notification services, including Firebase Cloud Messaging and Apple Push Notification service (APNs), to deliver notifications. We cannot guarantee that notifications will always be delivered or received. Personal information used to provide notifications is handled in accordance with our Privacy Policy. 17. Third-Party Services Guided by Grace uses trusted third-party service providers to help operate, secure, maintain, and improve the App. These services may include user authentication, cloud data storage, push notifications, analytics, and crash reporting. We currently use Google Firebase services, which may include Firebase Authentication, Cloud Firestore, Firebase Cloud Messaging, Firebase Analytics, and Firebase Crashlytics. The services we use may change from time to time as the App evolves. Your use of features provided through these services may also be subject to the applicable terms and privacy policies of those providers. While we make reasonable efforts to provide reliable access to the App, we are not responsible for interruptions or failures caused by third-party services that are beyond our reasonable control. Information processed through third-party services is handled in accordance with our Privacy Policy. 18. Privacy Policy Your privacy is important to us. Our collection, use, storage, and protection of personal information are governed by our Privacy Policy, which forms part of these Terms. Our Privacy Policy explains: * what personal information we collect; * how we use and protect your information; * how your journal entries are handled; * how Grace Circle information is managed; * how we use trusted third-party services; and * your privacy rights and choices. By creating an account or using the App, you acknowledge that you have read and understood our Privacy Policy. If there is any inconsistency between these Terms and the Privacy Policy regarding the handling of personal information, the Privacy Policy will prevail to the extent of that inconsistency. We may update our Privacy Policy from time to time. Where required by applicable law, we will notify users of material changes. Nothing in this section limits any rights you may have under applicable privacy or data protection laws. 19. Suspension and Termination We may suspend or terminate your account or restrict access to some or all features of the App if we reasonably believe that: * you have breached these Terms or our Community Guidelines; * your use of the App is unlawful, fraudulent, abusive, or harmful; * your account has been compromised or is being used without authorisation; * suspension is necessary to protect the safety, security, or wellbeing of users; * suspension is required by law or a lawful request from a government authority; or * suspension is reasonably necessary to protect the security or operation of the App. Where reasonably practicable, we will notify you of any suspension or termination. You may stop using the App and delete your account at any time. If your account is suspended or terminated: * your right to use the App will end; * access to your account and its features may be restricted or removed; and * we may retain information where required or permitted by law, as described in our Privacy Policy. Any provisions of these Terms that are intended to survive termination, including those relating to intellectual property, user-generated content, privacy, limitation of liability, indemnity, and governing law, will continue to apply. 20. Account Deletion You may delete your account at any time using the account deletion feature within the App. When you delete your account: * your access to the App will end; * your devotional progress, journal entries, and other account information will be deleted or anonymised within a reasonable period, subject to applicable law; * your profile will no longer be visible to other users; and * where reasonably practicable, content you have shared in Grace Circle may also be removed. In some cases, limited information may be retained where necessary to preserve community discussions, comply with legal obligations, prevent fraud, or protect the security of the App. We may retain certain information where required or permitted by law, including to comply with legal obligations, resolve disputes, prevent fraud, or protect the security and operation of the App. Further information is available in our Privacy Policy. If you have difficulty deleting your account, you may contact us using the details provided in these Terms or our Privacy Policy. 21. Availability of the Service We aim to make Guided by Grace available as consistently as reasonably possible. However, we do not guarantee that the App or all of its features will always be available, uninterrupted, secure, or error-free. The availability of the App may be affected by factors beyond our reasonable control, including maintenance, software updates, internet or telecommunications failures, third-party service providers, device compatibility, or other events outside our control. We may update, modify, suspend, or discontinue all or part of the App from time to time to improve the service, maintain security, comply with legal obligations, or support new features. Where reasonably practicable, we will provide notice of significant changes. You are responsible for ensuring that your device, operating system, and internet connection meet the requirements necessary to use the App. Nothing in this section limits any rights that cannot lawfully be excluded under applicable law. 22. Disclaimer of Warranties To the fullest extent permitted by law, Guided by Grace is provided on an "as is" and "as available" basis. While we make reasonable efforts to provide a reliable and secure service, we do not guarantee that: * the App will always be available, uninterrupted, or error-free; * all content will always be complete, accurate, or current; * the App will be free from bugs, viruses, or other harmful components; or * the App will meet every user's individual expectations or requirements. The devotional content is provided for inspirational and educational purposes only. Individual experiences and outcomes will vary. Grace Circle contains content submitted by users. We do not endorse or guarantee the accuracy of User-Generated Content. Nothing in these Terms excludes any rights or guarantees that cannot lawfully be excluded under applicable law. 23. Limitation of Liability To the fullest extent permitted by law, Guided by Grace and its owners, employees, contractors, licensors, affiliates, and service providers are not liable for any indirect, incidental, special, consequential, or punitive loss or damage arising from your use of, or inability to use, the App. This includes loss of data, devotional progress, journal entries, service interruptions, unauthorised account access beyond our reasonable control, User-Generated Content, and failures of third-party services. Nothing in these Terms excludes or limits liability for: * death or personal injury caused by negligence; * fraud or fraudulent misrepresentation; or * any liability that cannot lawfully be excluded under applicable law. 24. Indemnity To the fullest extent permitted by law, you agree to indemnify Guided by Grace against reasonable claims, losses, liabilities, costs, and expenses arising directly from: * your material breach of these Terms; * your unlawful use of the App; or * User-Generated Content that infringes another person's rights or breaches applicable law. This does not apply to the extent that any claim results from our own negligence, wilful misconduct, or breach of these Terms. 25. Changes to the App We may update, modify, improve, suspend, or discontinue all or part of the App from time to time to: * improve features or functionality; * fix bugs or security issues; * update devotional content; * comply with legal or regulatory requirements; or * improve the performance, security, or reliability of the App. We may release updates that are installed automatically or require you to download the latest version from the relevant app store. Where reasonably practicable, we will notify users of material changes that significantly affect the operation of the App. If you do not wish to continue using the App following a material change, you may stop using the App and delete your account at any time. 26. Changes to These Terms We may update these Terms from time to time to reflect changes to the App, applicable law, or our services. Where we make material changes, we will take reasonable steps to notify users, for example through the App or by email where appropriate. The updated Terms will include a revised Effective Date. By continuing to use the App after the updated Terms take effect, you agree to the revised Terms, except where applicable law requires your express consent. If you do not agree with the updated Terms, you should stop using the App and may delete your account at any time. 27. Governing Law and Jurisdiction These Terms are governed by the laws of England and Wales. If you are a consumer, nothing in these Terms affects any rights you may have under the mandatory consumer protection laws of your country of residence. Any dispute relating to these Terms or your use of the App will be subject to the jurisdiction of the courts of England and Wales, unless applicable law allows or requires the dispute to be heard in another jurisdiction. 28. Entire Agreement These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Guided by Grace regarding your use of the App and supersede any previous agreements relating to the App. Nothing in these Terms limits any rights that cannot lawfully be excluded under applicable law. 30. Severability If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. 31. Waiver If we choose not to enforce any provision of these Terms, this does not prevent us from enforcing that provision or any other provision at a later time.
